1. INTRODUCTION

These Terms & Conditions govern your use of www.OriginalSports and all related assets, including social media platforms, phone or chat interactions, and offline interactions. OriginalSports is owned and operated by MadanScissors (Madan Scissors is a renowned manufacturer, trader, and wholesaler in the scissor industry, celebrated in Meerut and beyond for the past 45 years.) 

1.2. By purchasing products or availing services from OriginalSports, you agree to these Terms & Conditions. Please carefully read and understand them before making any purchases. Your use of our assets signifies your acceptance of these terms, including any Additional Terms presented during product selection. In case of conflicts, Additional Terms take precedence.

2. OUR BUSINESS

2.1. OriginalSports provides a platform for purchasing products and services offered by third-party vendors (“Vendors”). Ownership of merchandise passes from Vendors directly to you.

2.2. OriginalSports reserves the right to modify, discontinue, or change any aspect of our services without prior notice. We may alter procedures, processes, or purchase conditions at any time, without liability.

3. PRODUCTS

3.1. OriginalSports offers a variety of products, and shipping is carried out according to our company policy, subject to potential changes.

3.2. A selection of products may be exclusively available online through our website. The availability of these products could be restricted, and any returns or exchanges are subject to the guidelines outlined in our Return Policy.

3.3. If a product is out of stock, our Customer Service Team will contact you. Refund requests for paid orders will be processed according to your payment method. The money will reflect on your card or in your bank account within 7 to 21 working days from when the refund request was raised. No refunds for Cash On Delivery (COD) payments will be provided as no payment was received by us.

3.4. If you receive a damaged product, contact our Customer Service Team for assistance. We will assess the damage and provide a suitable solution, which may include replacement or other corrective measures.

3.4.  We have taken great care to present the colors and images of our products as accurately as possible on our platform. However, please be aware that we cannot ensure precise color accuracy on your computer monitor’s display.

4. SERVICES

4.1. You are responsible for using purchased products appropriately. OriginalSports shall not be liable for any consequences arising from your usage.

4.2. By using our services, you confirm that you are of legal age to form a binding contract and are eligible to receive services under applicable laws.

4.3. OriginalSports is not responsible for payment deficiencies related to purchased products.

5.1. Pricing information for products will be disclosed at the time of your purchase.

5.2. While we strive for accuracy, errors may occur in pricing information. OriginalSports may contact you for instructions or cancel orders with incorrect prices, providing the option to modify or cancel your order.

5.3. We do not guarantee the lowest price and reserve the right to change prices and availability without notice.

6.1. When making payments, you may be required to provide accurate credit/debit card details to approved payment gateways. You agree not to use unlawfully owned cards.

6.2. Your provided information will only be used for necessary verifications or legal requirements, ensuring the security of your details.

7. DELIVERY

7.1. We verify shipping details before payment. If your location is not serviceable, kindly provide an alternative address.

7.2. Shipping multiple orders together may be attempted, but is not guaranteed.

11. INDEMNIFICATION AND LIABILITY

You hereby agree to indemnify, defend, and hold MadanScissors and its affiliates harmless from any and all losses, liabilities, claims, damages, demands, costs, and expenses, including legal fees and disbursements, as a result of any breach of representation, warranty, covenant, or agreement made by you or any obligations to be fulfilled under these supply terms or any additional terms related to product purchases.

In no event shall MadanScissors, its officers, directors, employees, partners, or vendors be liable to you, the vendor, or any third party for any special, incidental, indirect, consequential, or punitive damages, including but not limited to loss of use, data, or profits, regardless of foreseeability or whether MadanScissors was advised of the possibility of such damages. This limitation applies to all theories of liability, including breach of contract, warranty, negligence, or any other tortious action, arising from or connected to your purchase of products and services herein. Under no circumstances shall MadanScissors’s liability exceed the amount charged to you for the products or services that gave rise to the unlikely liability.

11.3 While utilizing any of the payment methods provided by OriginalSports, it is important to note that OriginalSports assumes no responsibility and bears no liability for any loss or damage that may directly or indirectly result from the following circumstances:

-Lack of authorization for any transaction(s).

-Exceeding the mutually agreed preset limit between you and your “Bank(s)” and/or Service Provider(s).

-Any payment-related issues that may arise during the transaction process.

-Decline of the transaction due to any other reason(s).

12. GOVERNING LAW

12.1. In the event of any disagreement or conflict that may arise at any point between the involved parties concerning the Terms and Conditions or the understanding of any of its clauses, as well as any current or future amendments or revisions thereof, the resolution shall be conducted following the laws of India. 

12.2. The competent jurisdiction for the settlement of such disputes shall rest with the courts located in Meerut, whose authority shall be exclusive in adjudicating these matters.

13. OFFERS, PROMOTIONS, CONTESTS

13.1. OriginalSports may introduce offers and contests with specific terms. These terms are subject to change without notice.

13.2. By participating, you release OriginalSports from any claims or demands.

13.3. Contest winners are decided by OriginalSports, with no obligation to disclose the mechanism of the same.

13.4. OriginalSports reserves the right to modify contest terms, and its decisions are final.

14. PRIORITY SHIPPING

14.1. We offer priority shipping at an additional cost, with the costs varying depending on the specific product and the delivery location’s pin-code.

14.2. Please note that this service is available exclusively for selected products and specific pin-codes. To confirm whether your desired product and pin-code are eligible for this service, kindly get in touch with our Customer Service team.

14.3. In the rare event of any unforeseen delays in the package’s arrival, which may occur due to circumstances beyond our control, OriginalSports shall not be held liable for such delays.

15.1. Originalsports and its suppliers and licensors expressly reserve all intellectual property rights in all text, programs, products, processes, technology, content, and other materials appearing on this site.

15.2. Access to this site does not confer or imply a license under any intellectual property rights of OriginalSports or any third party.

15.3. All rights, including copyright, in this website are owned by or licensed to Originalsports. Use of this website or its contents, except for personal, non-commercial use, is prohibited without permission. Reproduction, distribution, or exploitation of site content is strictly prohibited.

16. Termination

OriginalSports reserves the right to terminate this agreement at any time without notice, denying site access. Upon termination, all downloaded materials must be destroyed. Termination does not cancel obligations for ordered products or affect prior liabilities under these terms.
